Why were 4 AGLAW officers sent to my home the day after Kathy Mears (Assistant Commissioner for the Florida Department of Agriculture and Consumer Services) called me, yelling at me aggressively, because I said she and the pesticide department were incompetent? I said they were incompetent if they believe a thorough investigation can find 3 poisons, but only investigate one. Was this abuse of power? Please watch the videos on Costa Honey Farm's YouTube channel and decide.
https://youtube.com/@costahoneyfarm?si=oQ3tgQq8U9Xhs_-W
I emailed AGLAW asking for help several days before Florida Department of Agriculture' AES department requested security due to my "aggressiveness and hostility".
Why did AGLAW ignore my plea for help? AGLAW did not respond to my email.
Why did the AGLAW officers act like they don't know any pesticide and herbicide label laws? Why were they not interested at all in the investigation into pesticide misuse that already resulted in a 5,000 fine?

Subject: Unlawful application of a pesticide wiped out Costa Honey Farm
I need help. FDACS department of pesticide inspectors are destroying evidence and
hindering investigations. I filed complaints against each one. I want them investigated.
The Administrative Complaint is extremely lacking and completely ignores the fact that the
illegal application of a pesticide wiped out my apiary, Costa Honey Farm.
They refused to do thorough testing on and around my dead hives. I had to fight with them
to take a soil sample. That soil sample tested positive for a neonic and herbicide. The
picture Michelle took of a bee suit has a pesticide, the active ingredient is the same one
found in the soil sample, but not reported by any tech. After finding the unreported
herbicide and pesticide, they refused to call the previous pest control company and do
testing on her side of the fence to find out how the neonic got onto my side of the fence.
They ignored these findings even though I've been shoving their face in it.
Someone approved the disposal of the sprayed bees by the lab without doing any testing.
Who approved the disposal of the most important evidence in this case?
How can a tech's statement be evidence enough to destroy evidence before testing?
Especially a tech who egregiously misused pesticides that sprayed onto my hives (killing
them), changed his affidavit TREMENDOUSLY 26 days later, admittedly cannot identify
stinging creatures, even though he has been licensed since 2014. His ID card does indicate
he is even authorized to apply Taurus SC? His detailed report states that there was
bumblebee activity 500 actual count. He reported spraying a bumble bee hive/nest on a
swing. Bumble bees do not even swarm.
The pesticide department is extremely incompetent or they are corrupt. They should be
investigated. How can they not know how to take an algae sample? How can an inspector
not bring a bee suit to an apiary inspection? I had to call the Sheriff to make Dan do his job.
He just looked at and took pictures of the pile of sprayed dead bees and coached the
neighbor to use the word anaphylaxis. Erin had to collect the dead bees which were
supposed to be tested, but were destroyed instead.
Erin Jenkins has been, by far the most helpful of all FDACS. She was the only one that
cared about my hives destroying my ecosystem. She offered to personally remove the
hives. Why is she and her department extremely helpful and stands true to FDACS motto,
where the pesticide department acts like a bunch of corrupt politicians that are paid off by
rentokil?
I declined the disposal as of right now, because I want more inspections after finally being
able to view the affidavits. It took over a week for the zip file to be included in the public
information. I requested these new inspections based the dead hives not rotting, nor show
any signs of pests that should be there. She said the hives should start rotting after 4 days.
One hive has been queen less for 2 months. She emailed that she would get with the
proper department and get back to me. I'm hoping to hear back from her monday.
How many times did William Vernon instruct someone to use Taurus sc illegally? Who
investigates that? If illegal application is protocol, what s the penalty for ignorantly
murdering ecosystems and is he allowed to be employed?
Why is nothing being done to the tech who egregiously applied pesticide to soffits, which
sprayed on to my hives, wiping out Costa Honey Farm?
Why was the concentration level blatantly ignored even though the tech changed his story
from 100oz of Taurus sc into 2 gallons of water to .8 oz into a gallon and a slow kill acted as
a knock down? Why does the affidavit show 100oz for 2 gal and the pesticide use shows
50oz for 1 gallon, while the work order shows he used 2oz? Did he use one gallon or 2?
How did his memory get better a week later? If he did use 3.55% as initially indicated, what
does that do to everything the spray came into contact with, the soil and aquifer?
Why is there no affidavit for supervisor, Henry Smith Jr?
New information-
There has been a small amount of bees that have been on the fence down the edge of one
post. Whatever is attracting them is making them fall to the ground and die, while
attracting more bees. A guy power washed the other side of the fence, which I believe
pushed the chemical to my side. I want the dead bees under the clump on the fence, the
clump of live bees, and a swab of the fence where the bees are attracted to be tested
Because of the high probability of an egregious mixing misuse of a pesticide and the tech
admitted to spraying the eves and soffits, I am demanding extensive pesticide testing of all
of my hives, my apiary, both sides of the fence, and the brutton property immediately.
I want Fl Pest Control to pay for the extensive testing I'm requesting, since they were found
in violation of lawful pesticide application which wiped out Costa Honey Farm.
There is so much more. This is just my most urgent issues. You will be receiving a
complaint for each individual.
Thank you,
Dave Costa

After FDACS found FL Pest unlawfully applied a pesticide that wiped out Costa Honey
Farm, would you believe that Erin was the only one who reached out to me? She offered to
remove the hives, herself. Why is she the only one who seems to want to do their job
correctly? Why is she the only one answering any of my questions?
I had to decline her offer right now, because we discussed doing another inspection,
because there is no rotting or evidence of ants, wax moths, hive beetles, and other
common hive infestors in the dead hives. She said the hives start rotting after about 4 days.
One of my hives has been queenless for 2 months. This is not natural.
Please do not forget that when my neighbor found out we had piles of dead bees, she said
she would spray any bees on her property., so the possibility of vandalization should be
investigated.
Also, there has been zero investigation into the diuron and imidacloprid in the soil where it
should not be. Michelle's bee suit picture shows a product with a bottle of the pesticide
with imidacloprid as it's active ingredient right next to the bee suit. Why is that ignored?
Also, we found out the tech said he used a 3.55% mix in his 1st affidavit, summary of
service shows 2oz (no dilution noted), then changed it to a 0.06% mix after Michelle called
him to confirm the mix percentages. Why was he allowed to change his affidavit to match
the label 3 weeks after application and FDACS not be required to test to be sure he is not
lying to cover up an egregious misuse of a pesticide that wiped out Costa Honey Farm? Is
that the job of the inspector or the enforcement? This is worse than Dan coaching my
neighbor to use the word anaphylaxis.
Attached is a picture of the bees on the fence, taken today. They have been there for over 2
days. No queen. Some drop off and die and more are attracted. There's definitely some
type of attractant on there, so I want the bees on the fence, the dead bees under these
bees, and the fence swabbed on top of my other requests. This is the area where my
neighbor had someone pressure wash for a long time. This is most likely an illegal
application of a different pesticide.
The receipt for 3/27 service is missing.
Henry Smith's affidavit is missing.
The affidavit of the person receiving the call to kill a honey bee swarm on a hammock is
missing.
Why does the service history report say Western Exterminator Company instead of Fl Pest
Control?
In Brutton's affidavit, she claimed that they only sprayed the soffit on the front of the
house, but the tech reported spraying the front and sides on 3/27 and was planning to
return to finish the rear.
Dan's affidavit for Brutton is missing
Dan's bee samples are missing.
The report includes a 3rd trip by the tech, that Michelle was well aware of, because she
was interviewing Vernon when he told her he was at the property as they were speaking.
Where is the information for this 3rd trip as well as the 2nd trip? A 0.06 mix is only allowed
2x/year, so the dilutions are extremely important. How can the 3rd trip, be the initial
treatment?

Instead, I have to do fdacs job.
How did you miss the maxforce bottle in picture of the back of Webber s truck? Its active
ingredient is the exact neonic found in the soil on my side of the fence. Plus, he proved the
ultimate incompetence and admitted he cannot identify pests, and his memory (of what
he just did) improved a week later, a miracle. Is someone who cannot accurately identify
pests allowed to use highly regulated poisons?
Did you guys even read the affidavits and labels? There are so many blatant and extremely
elementary inaccuracies.
With the eastern winds and the tech changing his story from 50oz/ gallon to 0.8oz per
gallon, I want every hive tested immediately meaning today. If it doesn t show levels
higher than the .8oz per gallon, I ll pay for all testing plus $5000 for me being difficult,
stupid, and unreasonable. Why does Mrs Brutton s invoice only show 2oz/ gallon?
Why is the fact that he applied Taurus sc to the eves/soffitt 2 times, 3/27 and 4/9
ignored??? The eves and soffits are just under the roofline, so, with any wind at all, the
spray would most definitely directly hit my hives that are about 15 away. Did the pesticide
inspectors know this and not demand every hive was tested? Why would there be no
sense of urgency for such an egregious misuse of a pesticide that was admitted by the
tech??? Who investigates that? These poisoned hives are on the side of my home on a 1/3
acre, not in a field, far away from living quarters.
Extremely simple math would show he would have had to use more product to do a top
and bottom perimeter spray, to cover double the area.
Eddie picked up the remaining dead bees with his bare hands after Webber sprayed that
side of the house the day before. Is FL Pest Control putting state employees at risk? If not,
what do you call it?
4/17, When I yelled at the tech for killing my bees (only after he turned his back on me
when I told him there is a registered commercial apiary on the other side of the fence and
he killed my bees), the tech was there was to apply the 1st quarterly perimeter treatment.
What was the other foundation and soffit perimeter treatment on 3/27 and 4/9 called?
They called the sheriff on me for this and a guy called me a cracker. Is this a racial crime?
In what clown world is this allowed to happen ?
He did not report how much he doused the swarm with the 2 times he admittedly doused
them and the pesticide inspectors are ok with that, even though it s federally mandated.
Did Mrs Brutton mislead fl pest, since she thought they were my honey bees and knocked
on my door to have me remove them when I was unavailable?
Who told him it was a hornets nest? Hornet is not labeled anyways.
According to the Stinging insects pages, why was a beekeeper not called to relocate the
swarm? Why was the area not roped off? If he thought they were wasps, why did they not
use an aerosol insecticide? Why was the nest not removed?
Why is there no mention of the illegal application destroying my apiary?
Why is there no mention of a lethal level of Fipronil being inside a hive?
Why are you blatantly ignoring leaving contaminated bees for 2 weeks in the illegal
application?
How many times did William Vernon instruct someone to use Taurus sc illegally? Who
investigates that? If illegal application is protocol, what s the penalty for ignorantly
murdering ecosystems and is he allowed to be employed?
Why was the concentration level blatantly ignored even though the tech changed his story
from 100oz of Taurus sc into 2 gallons of water to .8 oz into a gallon and a slow kill acted
as a knock down? Why does the affidavit show 100oz for 2 gal and the pesticide use
shows 50oz for 1 gallon? Did he use one gallon or 2? How did his memory get better a
week later?
And you had the (smoking gun) sprayed bees destroyed by the lab instead of having them
tested.
This guy was trusted instead of testing the bees. The guy the couldn t determine the exact
kind of insect? He really couldn t tell the difference between hornets, wasps and
honeybees?? He also doesn t know the difference between a swing and a hammock. And
you take his statement as truth and fact?
Why was the wind report ignored? It shows winds E-NE and E-SE at a speed of 4.49-5.24,
which would mean he s most definitely overspraying into my commercial apiary and
directly onto my hives. This is highly illegal.
The reason diuron and imidaclorprid was not able to be determined where it came from is
because you didn t even want to look. I had to force you to test the soil. I want you to be
accurate, so please rewrite it to add that there was zero testing to find out if there s more
on the other side of the fence and the inspectors refused to call the previous pest control
company to confirm.
I refused to sign Dan s notice of inspection because it was inaccurate and he was
extremely argumentative to the point I asked if he was on the payroll of rentokil. Why is
there no mention of me having to call the sheriff to make Dan do his job?
He had no ID tag and he had to search for a business card.
Mrs Brutton knew about an apiary next door just days after she moved on, because I told
her.
Why are there no consequences for Mr Weber when he admitted he was not directed to
use it to kill a swarm, but only to perform treatment. How was it found that Vernon
instructed an employee to kill a honeybee swarm? How can someone applying pesticides
not be able to identify pests?
Why does the screenshot of fl pest show bumblebees with an actual count of 500 if he
can t identify bees? How many times did his story change????
Why would you assume he paid attention to the 7am-8am live webinar, when he obviously
and admittedly can t identify pests?
DuraFlex zc is in a picture in the truck, but 2 active ingredients are not tested. It has
sucralose and is an attractant. I have bees acting strange on the fence, like they are
attracted to something. They have been there for more than 24hrs. I requested to have the
fence swabbed (per the investigation), but that was refused, even though I offered to pay
for all testing that the government refused to pay for. This product should only be used in
bait stations and never found on a fence. Its target pest is ants. Could them trying to wash
away evidence, pushed it to my side of the fence? What does it take to do a thorough and
accurate investigation?
What are the results of the several complaints on Dan Sumner?
Thank you,
Dave Costa

The information Deputy Manning has is conflicting with the information FDACS has given to

Is the case open or closed?
Are the future test results going to be included in the case or not? When do you plan on

Are the case findings going to mention that the illegal application wiped out Costa Honey
Farm?
Why is FDACS still refusing to answer any of my questions?

The disrespect and lack of help you give the victim of an admitted and proven egregious

That s all I have heard from fdacs. Why have zero questions been answered? Literally
zero questions have been answered. Is that ok?
My neighbor watered her yard this morning where the swarm was sprayed, for 1.5hrs. I
just took a video of heavy bee activity over her yard. It didn t appear as organized as a
swarm, but it may be the fipronil frying their brains. Did excessively watering the yard
reactivate the poison that attracts bees? That would be sweet irony. It s hard to laugh at
how her spraying to get rid of bees has actually caused a tremendous amount of more
activity, because the hives are poisoned. The soil was already saturated from the rain we

The bees are still gathering on the fence in the same spot. It s been a week now, but

want more thorough testing now!!!!!!!!!!!!!!!! You have a tech admitting to spraying
my neighbor s soffit with a strong mix of Fiprinol on a day with 5mph E winds and
found fipronil on bees INSIDE my hive. It s impossible to not have the spray to the
soffits not get directly on my hives, because the hives are about 10-12 due east

The affidavit of the person receiving the call to kill a honey bee swarm on a
hammock is missing.
Why does the service history report say Western Exterminator Company instead of
Fl Pest Control?
In Brutton's affidavit, she claimed that they only sprayed the soffit on the front of
the house, but the tech reported spraying the front and sides on 3/27 and was
planning to return to finish the rear.
Dan's affidavit for Brutton is missing
Dan's bee samples are missing.
The report includes a 3rd trip by the tech, that Michelle was well aware of, because
she was interviewing Vernon when he told her he was at the property as they were
speaking. Where is the information for this 3rd trip as well as the 2nd trip? A 0.06
mix is only allowed 2x/year, so the dilutions are extremely important. How can the
3rd trip, be the initial treatment?

How did you miss the maxforce bottle in picture of the back of Webber s truck?
Its active ingredient is the exact neonic found in the soil on my side of the fence.
Plus, he proved the ultimate incompetence and admitted he cannot identify
pests, and his memory (of what he just did) improved a week later, a miracle. Is
someone who cannot accurately identify pests allowed to use highly regulated
poisons?
Did you guys even read the affidavits and labels? There are so many blatant and
extremely elementary inaccuracies.
With the eastern winds and the tech changing his story from 50oz/ gallon to 0.8oz
per gallon, I want every hive tested immediately meaning today. If it doesn t show
levels higher than the .8oz per gallon, I ll pay for all testing plus $5000 for me
being difficult, stupid, and unreasonable. Why does Mrs Brutton s invoice only
show 2oz/ gallon?
Why is the fact that he applied Taurus sc to the eves/soffitt 2 times, 3/27 and 4/9
ignored??? The eves and soffits are just under the roofline, so, with any wind at
all, the spray would most definitely directly hit my hives that are about 15 away.
Did the pesticide inspectors know this and not demand every hive was tested?
Why would there be no sense of urgency for such an egregious misuse of a
pesticide that was admitted by the tech??? Who investigates that? These
poisoned hives are on the side of my home on a 1/3 acre, not in a field, far away
from living quarters.
Extremely simple math would show he would have had to use more product to do
a top and bottom perimeter spray, to cover double the area.
Eddie picked up the remaining dead bees with his bare hands after Webber
sprayed that side of the house the day before. Is FL Pest Control putting state
employees at risk? If not, what do you call it?
4/17, When I yelled at the tech for killing my bees (only after he turned his back on
me when I told him there is a registered commercial apiary on the other side of
the fence and he killed my bees), the tech was there was to apply the 1st
quarterly perimeter treatment. What was the other foundation and soffit
perimeter treatment on 3/27 and 4/9 called? They called the sheriff on me for this
and a guy called me a cracker. Is this a racial crime? In what clown world is this
allowed to happen ?
He did not report how much he doused the swarm with the 2 times he admittedly
doused them and the pesticide inspectors are ok with that, even though it s
federally mandated.
Did Mrs Brutton mislead fl pest, since she thought they were my honey bees and
knocked on my door to have me remove them when I was unavailable?
Who told him it was a hornets nest? Hornet is not labeled anyways.
According to the Stinging insects pages, why was a beekeeper not called to
relocate the swarm? Why was the area not roped off? If he thought they were
wasps, why did they not use an aerosol insecticide? Why was the nest not
removed?
Why is there no mention of the illegal application destroying my apiary?
Why is there no mention of a lethal level of Fipronil being inside a hive?
Why are you blatantly ignoring leaving contaminated bees for 2 weeks in the
illegal application?
How many times did William Vernon instruct someone to use Taurus sc illegally?
Who investigates that? If illegal application is protocol, what s the penalty for
ignorantly murdering ecosystems and is he allowed to be employed?
Why was the concentration level blatantly ignored even though the tech changed
his story from 100oz of Taurus sc into 2 gallons of water to .8 oz into a gallon and
a slow kill acted as a knock down? Why does the affidavit show 100oz for 2 gal
and the pesticide use shows 50oz for 1 gallon? Did he use one gallon or 2? How
did his memory get better a week later?
And you had the (smoking gun) sprayed bees destroyed by the lab instead of
having them tested.
This guy was trusted instead of testing the bees. The guy the couldn t determine
the exact kind of insect? He really couldn t tell the difference between hornets,
wasps and honeybees?? He also doesn t know the difference between a swing
and a hammock. And you take his statement as truth and fact?
Why was the wind report ignored? It shows winds E-NE and E-SE at a speed of
4.49-5.24, which would mean he s most definitely overspraying into my
commercial apiary and directly onto my hives. This is highly illegal.
The reason diuron and imidaclorprid was not able to be determined where it
came from is because you didn t even want to look. I had to force you to test the
soil. I want you to be accurate, so please rewrite it to add that there was zero
testing to find out if there s more on the other side of the fence and the inspectors
refused to call the previous pest control company to confirm.
I refused to sign Dan s notice of inspection because it was inaccurate and he was
extremely argumentative to the point I asked if he was on the payroll of rentokil.
Why is there no mention of me having to call the sheriff to make Dan do his job?
He had no ID tag and he had to search for a business card.
Mrs Brutton knew about an apiary next door just days after she moved on,
because I told her.
Why are there no consequences for Mr Weber when he admitted he was not
directed to use it to kill a swarm, but only to perform treatment. How was it found
that Vernon instructed an employee to kill a honeybee swarm? How can someone
applying pesticides not be able to identify pests?
Why does the screenshot of fl pest show bumblebees with an actual count of 500
if he can t identify bees? How many times did his story change????
Why would you assume he paid attention to the 7am-8am live webinar, when he
obviously and admittedly can t identify pests?
DuraFlex zc is in a picture in the truck, but 2 active ingredients are not tested. It
has sucralose and is an attractant. I have bees acting strange on the fence, like
they are attracted to something. They have been there for more than 24hrs. I
requested to have the fence swabbed (per the investigation), but that was
refused, even though I offered to pay for all testing that the government refused to
pay for. This product should only be used in bait stations and never found on a
fence. Its target pest is ants. Could them trying to wash away evidence, pushed it
to my side of the fence? What does it take to do a thorough and accurate
investigation?
What are the results of the several complaints on Dan Sumner?
